By 10:00 a.m., a crowd had gathered by the California Supreme Court in San Francisco. They awaited word of the Court\u2019s decision.<\/p>\n<p style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_upheld_090526\/_w2w9190_std.jpg\" width=\"500\" height=\"333\" \/><br \/>\n&#8220;Shame on you. Shame on you.&#8221;<\/p>\n<p>The decision, to uphold voters\u2019 passage of a ban on gay marriage last year, wasn\u2019t entirely unexpected. It was a blow that affected even public officials. City Attorney Dennis Herrera held a press conference.<\/p>\n<p>\u201cToday\u2019s ruling doesn\u2019t mean marriage equality will never be achieved,\u201d he said. \u201cIt simply means that, in the end, we can\u2019t rely on the courts to secure it.\u201d He added, \u201cThe final decisive round will not be won in the legal arena, it will be won in the electoral arena.\u201d<\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_upheld_090526\/_w2w9268_std.jpg\" width=\"500\" height=\"333\" \/><br \/>\nAttorney Raymond Marshall, National Center for for Lesbian Rights Exec. Almost immediately, protesters blocked traffic on nearby Van Ness Avenue, a main thoroughfare. There were between 100 and 200 arrests, which were processed peacefully and efficiently.<\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_upheld_090526\/_w2w9498_std.jpg\" width=\"500\" height=\"333\" \/><\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_upheld_090526\/_w2w9462_std.jpg\" width=\"500\" height=\"333\" \/><\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_upheld_090526\/_w2w9420_std.jpg\" width=\"500\" height=\"333\" \/><\/p>\n<p>Early that evening, as many as three thousand protesters gathered to begin a march from City Hall to Yerba Buena Gardens&#8230;<\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_rally_090526\/_w2w9516_std.jpg\" width=\"500\" height=\"328\" \/><\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_rally_090526\/_w2w9520_std.jpg\" width=\"500\" height=\"333\" \/><\/p>\n<p>\u2026and passed by the state Supreme Court, where CHP officers stood guard and remained on watch.<\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_rally_090526\/_w2w9522_std.jpg\" width=\"500\" height=\"333\" \/><\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_rally_090526\/_w2w9531_std.jpg\" width=\"500\" height=\"333\" \/><\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_rally_090526\/_w2w9755_std.jpg\" width=\"500\" height=\"333\" \/><\/p>\n<p>Quite a number of protesters found powerful and inventive ways to make their point.<\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_rally_090526\/_w2w9609_std.jpg\" width=\"333\" height=\"500\" \/><br \/>\nA <a href=\"http:\/\/en.wikipedia.org\/wiki\/Winged_monkeys\">winged Wizard of Oz monkey<\/a><\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_rally_090526\/_w2w9551_std.jpg\" width=\"500\" height=\"333\" \/><br \/>\nPhotog ace Michael Macor captures a dancing protester.<\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_rally_090526\/_w2w9596_std.jpg\" width=\"500\" height=\"333\" \/><br \/>\nA same-sex couple reflects on the court&#8217;s decision<br \/>\nat the Martin Luther King Memorial.<\/p>\n<p>At one point, emotions and alcohol set off a limited confrontation that led to an unpleasant arrest of a protester.<\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_rally_090526\/_w2w9632_std.jpg\" width=\"500\" height=\"333\" \/><\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_rally_090526\/_w2w9646_std.jpg\" width=\"500\" height=\"333\" \/><\/p>\n<p>Which then led to about 500 people diverting themselves to an unplanned route, leaving hapless drivers unexpectedly surrounded.<\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_rally_090526\/_w2w9722_std.jpg\" width=\"500\" height=\"333\" \/><\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_rally_090526\/_w2w9710_std.jpg\" width=\"500\" height=\"333\" \/><\/p>\n<p>Marriage equality activists expect to achieve their goal in California via the ballot box in 2010, or 2012 at the latest.<\/p>\n<p><strong>Notable Quotes<\/strong><\/p>\n<p><em>&#8211; <strong>Luke Otterstad, American River College:<\/strong><\/em> \u201cMarriage is a privilege and that means it\u2019s exclusive. We exclude marriages based on age. We exclude marriages based on the number of people involved in the partnership. It\u2019s an exclusive relationship between a man and a woman. Marriage is a privilege that is granted to specific parties, and we\u2019ve determined that in California that\u2019s a man and a woman.\u201d<\/p>\n<p><em>&#8211; <strong>Molly Mckay, Marriage Equality USA:<\/strong><\/em> \u201cThe struggle continues. We\u2019re not done. We keep marching. It\u2019s not over. We\u2019re going to get right back out there. We will become stronger. We will have more allies. We will win. We will prevail.\u201d<\/p>\n<p><em>&#8211; <strong>Supervisor Bevan Dufty:<\/strong><\/em> \u201cWe will prevail. This is an unstoppable movement. This is an era in which California has really fallen behind in terms of our state not being a leader anymore &#8211; and we\u2019re not even a follower anymore. This decision reflects that you shouldn\u2019t have peoples\u2019 rights under a constitution determined by a popular vote. I fundamentally think that was the right approach, and I think our people argued well, and we have to go back to the ballot. But I think we are wiser for having lost in November and I think we\u2019ll win the next time we go to the ballot.\u201d<\/p>\n<p>\u201cI think it\u2019s bad. I think there\u2019s just a lot of anger, and it\u2019s going to be a tough time for the City for the next couple of days.\u201d<\/p>\n<p>Dufty said the Marriage Equality movement is targeting the 2010 ballot to legalize same-sex marriage.<\/p>\n<p><em>&#8211; <strong>City Attorney Dennis Herrera:<\/strong><\/em> \u201cI think we\u2019ve come to know that no one who has been part of this struggle, whether gay, lesbian, or straight, married or single, will ever stop fighting for equality.\u201d<\/p>\n<p>\u201cToday we\u2019re faced with a disappointing decision, but I also think it could have been worse. Yes, we\u2019re disappointed Proposition 8 was upheld, but we\u2019re also grateful that Prop 8 advocates did not succeed in their cruel effort to unmarry 18,000 lawfully wedded couples.\u201d<\/p>\n<p>Herrera said he was grateful for Justice Moreno\u2019s dissent: \u201cHe stood fast for our constitutional guarantees and eloquently affirmed the judiciary\u2019s role in defending them.\u201d<\/p>\n<p><em>&#8211; <strong>Kate Kendall, Executive Director National Center for Lesbian Rights:<\/strong><\/em> \u201cIt is impossible to square the elation that we felt just a year ago with the grief that we feel today, and it is impossible to reconcile the court\u2019s ruling from a year ago with its upholding of Prop 8 today. In upholding Prop 8, the court tarnishes that landmark historic victory for equality and dignity and diminishes it\u2019s own legacy as a champion of fairness and justice. But, it is clear, this is not the end.\u201d<\/p>\n<p><em>&#8211; <strong>Shannon Minter, Legal Director National Center for Lesbian Rights:<\/strong><\/em> \u201cThere\u2019s no way to sugar coat it. This is a very sad day for our community.\u201d<\/p>\n<p>\u201cThe human impact of this decision is going to be devastating and overwhelming.\u201d<\/p>\n<p>\u201cThe court\u2019s job is to act as a check on the abuse of majority power, to protect minority rights, to stand up for equal protection \u2013 and the court sidestepped that responsibility with this decision today and Justice Moreno, in his dissent, got it exactly right promising equal treatment to some is fundamentally different than promising equal treatment to all.\u201d<\/p>\n<p>\u201cGranting same-sex couples all the rights enjoyed by opposite-sex couples, except the right to call their family relationship a marriage, still denies them equal treatment.\u201d<\/p>\n<p><em>&#8211; <strong>Attorney Raymond Marshall:<\/strong><\/em> \u201cIt is sad that our court has taken the decision to deprive any group of citizens a fundamental right to enjoy under the Constitution\u2026 a fundamental right to marry.\u201d<\/p>\n<p>\u201cI\u2019m very optimistic that the words that were used during the (Obama) campaign, \u2018yes we can,\u2019 will in fact be the case. Yes we can. Yes we will. The right to marry, gay and lesbian, will happen. History is on our side.\u201d<\/p>\n<p><em>&#8211; <strong>Geoff Kors, Executive Director Equality California:<\/strong><\/em> \u201cIt is extremely disappointing that the court is allowing the majority to determine a fundamental right of a suspect minority. But the court\u2019s ruled; they said \u2018it\u2019s up to the voters,\u2019 so we\u2019ll take this back to the voters and I am confidant momentum is on our side and we will win back marriage and keep it permanently for same-sex couples in California.\u201d<\/p>\n<p>\u201cEquality California wants to go back to the voters in November 2010 if there\u2019s a clear path to victory and we know we\u2019ll have the resources, both people power and money, to win.\u201d<\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2009\/prop8_upheld_090526\/_w2w9196_std.jpg\" width=\"344\" height=\"500\" \/><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A performance artist\u00a0 stood on the ledge of the Martin Luther King Memorial at Yerba Buena Gardens during an evening rally following the California Supreme Court&#8217;s decision that upheld Proposition 8.
