File photo by Luke Thomas.<\/p><\/div>\n<p><strong>By Luke Thomas<\/strong><\/p>\n<p><em>Editor&#8217;s Note: This report has been updated with a response from City Attorney Dennis Herrera spokesperson Matt Dorsey.<\/em><\/p>\n<p>March 27, 2012, 9:00 am.<\/p>\n<p>Defense counsel representing suspended Sheriff Ross Mirkarimi filed a writ today in Superior Court seeking to reinstate the former District 5 supervisor as the lawfully elected Sheriff of San Francisco, <em>Fog City Journal<\/em> can report.<\/p>\n<p>Mayor Ed Lee \u201cacted outside his legal authority\u201d when he suspended Sheriff Mirkarimi, according to Mirkarimi\u2019s new defense attorney, David Waggoner.<\/p>\n<p><!--more-->\u201cThere is no basis in law to justify charges of official misconduct,\u201d Waggoner told <em>FCJ<\/em>, \u201cAnd there\u2019s no evidence to support that my client misused the office of sheriff.\u201d<\/p>\n<p>Mirkarimi <a href=\"http:\/\/www.fogcityjournal.com\/wordpress\/3496\/sheriff-ross-mirkarimi-im-sorry\/\">pleaded guilty<\/a> last week to one count of misdemeanor false imprisonment stemming from an alleged domestic violence incident involving his wife, Eliana Lopez, on New Year\u2019s Eve.\u00a0 He was <a href=\"http:\/\/www.fogcityjournal.com\/wordpress\/3297\/mirkarimi-inauguration-celebratory-despite-cloud\/\">sworn into office<\/a> January 8.<\/p>\n<p>Lee, who <a href=\"http:\/\/www.fogcityjournal.com\/wordpress\/3511\/mayor-lee-suspends-sheriff-mirkarimi-interim-named-peskin-calls-on-mirkarimi-to-resign\/\">suspended Mirkarimi<\/a> last Wednesday &#8211; without pay &#8211; said, \u201cSheriff Mirkarimi\u2019s actions and confession of guilt clearly fall below these standards of decency and good faith, rightly required of all public officials,\u201d referring to an <a href=\"http:\/\/www.fogcityjournal.com\/wordpress\/3481\/overheard-on-fog-city-is-mirkarimi-guilty-of-official-misconduct\/\">untested component of official misconduct<\/a>, as defined in the city Charter:<\/p>\n<p style=\"padding-left: 30px;\">[\u201c<em>Official misconduct means any wrongful behavior by a public officer in relation to the duties of his or her office<\/em>, willful in its character, including any failure, refusal or neglect of an officer to perform any duty enjoined on him or her by law, <strong><em>or conduct that falls below the standard of decency, good faith and right action impliedly required of all public officers and including any violation of a specific conflict of interest or governmental ethics law<\/em><\/strong>. When any City law provides that a violation of the law constitutes or is deemed official misconduct, the conduct is covered by this definition and may subject the person to discipline and\/or removal from office.\u201d (Emphasis added)]<\/p>\n<p>The <a href=\"http:\/\/en.wikipedia.org\/wiki\/Mandamus\">writ of mandamus<\/a> makes three legal arguments as to why Mirkarimi&#8217;s suspension is illegal:<\/p>\n<p style=\"padding-left: 30px;\">&#8211; The conduct at issue occurred before Mirkarimi assumed the Sheriff\u2019s office and cannot be the basis for suspension.<\/p>\n<p style=\"padding-left: 30px;\">&#8211; Mayor Lee\u2019s summary suspension of Mirkarimi, without pay, for a misdemeanor which does not constitute moral turpitude, is a denial of due process.<\/p>\n<p style=\"padding-left: 30px;\">&#8211; The language of the Charter defining &#8220;official misconduct&#8221; is unconstitutionally vague.<\/p>\n<p>According to Waggoner, \u201cBecause Mirkarimi was not sheriff at the time of the alleged misconduct, Lee\u2019s suspension amounts to an abuse of discretion.\u00a0 We are a city and nation of laws, and there is a legal standard that must be followed.\u00a0 By suspending the Sheriff for conduct that occurred before he assumed office and is not directly related to his job duties, Mayor Lee failed to follow the law.\u201d<\/p>\n<div style=\"width: 510px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.fogcityjournal.com\/images\/photos2008\/va_tony_hall_ethics_080609\/mw2w8063_std.jpg\" alt=\"\" width=\"500\" height=\"333\" \/><p class=\"wp-caption-text\">Mirkarimi defense attorney David Waggoner.<\/p><\/div>\n<p>Waggoner, a litigation attorney who enjoys a reputation for leaving no stone unturned, has successfully defended several high-profile clients before the city\u2019s Ethics Commission, a five-member quasi-judicial body consisting of political appointees.<\/p>\n<p>Waggoner will ask the Superior Court to set a court date to hear arguments on the writ in the next week.<\/p>\n<p>If Mirkarimi is unsuccessful in Superior Court, the city\u2019s Ethics Commission is charged with holding a hearing &#8211; expected to begin in late April when Ms. Lopez returns from a <a href=\"http:\/\/www.sfgate.com\/cgi-bin\/article.cgi?f=\/c\/a\/2012\/03\/23\/BACG1NPLGQ.DTL&amp;tsp=1\">court-approved visit to her native homeland, Venezuela<\/a> &#8211; and submit its findings to the Board of Supervisors for a vote.\u00a0 Nine of eleven supervisors, or three-fourths of the Board\u2019s sitting members, must vote in the affirmative to remove an elected official from public office.<\/p>\n<p>The Ethics Commission proceeding is without precedent and could involve an interesting witness list, Waggoner said.<\/p>\n<p>Responding to the writ filing, City Attorney Dennis Herrera spokesperson Matt Dorsey said, &#8220;We&#8217;re aware of the news report in <em>Fog City Journal<\/em> about today&#8217;s Superior Court filing.
