File photo by Luke Thomas.<\/p><\/div>\n<p><strong>By <a href=\"http:\/\/www.fogcityjournal.com\/wordpress\/author\/luke\/\">Luke Thomas<\/a><\/strong><\/p>\n<p>April 11, 2012, 4:00 pm<\/p>\n<p>Citing a lack of authority and a conflict of interest, defense counsel representing suspended Sheriff Ross Mirkarimi today filed a motion in San Francisco Superior Court seeking to disqualify the office of City Attorney Dennis Herrera from representing Mayor Ed Lee, <em>Fog City Journal<\/em> can report.<\/p>\n<p>\u201cThe City Attorney cannot draft the Mayor&#8217;s charges and then turn around and act as an independent prosecutor for the City before the\u00a0Ethics Commission, all while advising the Ethics Commission at the same time and continuing to represent the Mayor,\u201d said defense counsel David Waggoner, responding to <em>FCJ<\/em> inquiry.\u00a0\u201cThe City Attorney&#8217;s actual conflicts of interest may have already destroyed any possible hope of a fair hearing before the Ethics Commission.\u201d<\/p>\n<p><!--more-->According to the brief, \u201cNothing in the Charter authorizes the City Attorney to represent the Mayor, or any other elected officer, in any legal proceeding, under any other circumstances.\u201d<\/p>\n<div id=\"attachment_3577\" style=\"width: 181px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-3577\" class=\"size-full wp-image-3577\" title=\"dennis_herrera_cropped\" src=\"http:\/\/www.fogcityjournal.com\/wordpress\/wp-content\/plugins\/2012\/04\/dennis_herrera_cropped.jpg\" alt=\"\" width=\"171\" height=\"245\" \/><p id=\"caption-attachment-3577\" class=\"wp-caption-text\">City Attorney Dennis Herrera.<\/p><\/div>\n<p>Additionally, the brief argues, \u201cThe City Attorney cannot ethically serve as both the prosecutor of this attempt to remove Sheriff Mirkarimi, and the lawyer for one of the supposedly neutral fact-finding and decision-making bodies, the Ethics Commission.\u201d<\/p>\n<p>It is the latest motion to be filed by Mirkarimi in his quest for justice. A previous motion, filed March 27, <a href=\"http:\/\/www.fogcityjournal.com\/wordpress\/3520\/mirkarimi-defense-files-writ-to-overturn-lees-suspension\/\">seeks to reinstate<\/a> the former District 5 supervisor as the lawfully elected Sheriff of San Francisco.\u00a0 That hearing has been scheduled for April 20.<\/p>\n<p>Lee <a href=\"http:\/\/www.fogcityjournal.com\/wordpress\/3511\/mayor-lee-suspends-sheriff-mirkarimi-interim-named-peskin-calls-on-mirkarimi-to-resign\/\">suspended<\/a> Mirkarimi without pay March 21 after Mirkarimi <a href=\"http:\/\/www.fogcityjournal.com\/wordpress\/3496\/sheriff-ross-mirkarimi-im-sorry\/\">pleaded guilty<\/a> March 19 to one count of misdemeanor false imprisonment stemming from an alleged domestic violence incident involving his wife, Eliana Lopez, on New Year\u2019s Eve.\u00a0 Mirkarimi was <a href=\"http:\/\/www.fogcityjournal.com\/wordpress\/3297\/mirkarimi-inauguration-celebratory-despite-cloud\/\">sworn into office<\/a> January 8.<\/p>\n<p>Responding, Herrera spokesperson Matt Dorsey told <em>FCJ<\/em>, \u201cThis is just a procedural dispute about an administrative process.\u00a0 The City Attorney\u2019s office has lawyers assigned to every commission in city government.\u201d<\/p>\n<p>\u201cWe have ethical screens in place for about two-dozen quasi judicial functions citywide.\u00a0 They assure independence and protect due process rights.\u00a0 It\u2018s no different for the Ethics Commission and we\u2019re confident the court will agree,\u201d Dorsey added.<\/p>\n<p>A hearing on the motion has been set for April 19 at 9:30 am.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>It is the latest motion to be filed by Mirkarimi in his quest for justice.
