File photo by Luke Thomas.<\/p><\/div>\n<p><strong>By <a href=\"http:\/\/www.fogcityjournal.com\/wordpress\/author\/luke\/\">Luke Thomas<\/a><\/strong><\/p>\n<p>April 14, 2012, 11:30 am.<\/p>\n<p>The office of City Attorney Dennis Herrera will not represent the Ethics Commission or the Board of Supervisors over charges of official misconduct leveled by Mayor Ed Lee against suspended Sheriff Ross Mirkarimi, <em>Fog City Journal<\/em> can report.<\/p>\n<p>Due to a <a href=\"http:\/\/www.fogcityjournal.com\/wordpress\/3575\/mirkarimi-defense-files-motion-to-disqualify-city-attorney\/\">conflict of interest raised by Mirkarimi\u2019s defense team<\/a>, filed Wednesday in San Francisco Superior Court, attorney Scott Emblidge of Moscone, Emblidge and Sater LLP, has been assigned to represent both the Ethics Commission and Board of Supervisors.<\/p>\n<p>\u201cThere\u2019s no legal requirement in this case for outside counsel but if, out of an abundance of caution, the Ethics Commission and the Board of Supervisors made that choice, it will be authorized by the City Attorney \u2013 and that has happened in this case,\u201d Herrera spokesperson Matt Dorsey told <em>FCJ<\/em>.<\/p>\n<p>\u201cThis is consistent with past practices in the Ed Jew case,\u201d Dorsey added. \u201cThe Ethics Commission and Board will have outside, independent, pro-bono legal counsel.\u00a0 We think that renders the legal issue in Superior Court moot, but this will all play out in the next week.\u201d<\/p>\n<div id=\"attachment_3587\" style=\"width: 118px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-3587\" class=\"size-full wp-image-3587\" title=\"Emblidge\" src=\"http:\/\/www.fogcityjournal.com\/wordpress\/wp-content\/plugins\/2012\/04\/Emblidge.jpg\" alt=\"\" width=\"108\" height=\"162\" \/><p id=\"caption-attachment-3587\" class=\"wp-caption-text\">Scott Emblidge<\/p><\/div>\n<p>Herrera\u2019s office will continue to represent Lee in Superior Court and in the upcoming Ethics Commission hearing, tentatively scheduled to begin April 23.<\/p>\n<p>The Court is scheduled to consider the conflict of interest issue April 19.
