Stone<\/a><\/strong><\/p>\n<p>March 27, 2013<\/p>\n<p>On January 22, 1973, the U.S. Supreme Court in\u00a0<a href=\"http:\/\/www.law.cornell.edu\/supct\/html\/historics\/USSC_CR_0410_0113_ZS.html\" target=\"_blank\" rel=\"noopener\">Roe v. Wade<\/a>\u00a0legalized abortion. \u00a0In this case, Jane Roe, a pseudonym for Norma Leah McCorvey (n\u00e9e Nelson), brought a class action suit challenging the constitutionality of a Texas criminal abortion law prohibiting abortion except for the purpose of saving a mother&#8217;s life.\u00a0\u00a0 In its ruling, the Supreme Court stated, &#8220;except from criminality, only a life-saving procedure on the mother&#8217;s behalf without regard to the stage of her pregnancy and other interests involved violate the Due Process Clause of the Fourteenth Amendment, which protects against state action the right to privacy, including a woman&#8217;s qualified right to terminate her pregnancy.&#8221;<\/p>\n<p><i>Roe<\/i><b>\u00a0<\/b>established a &#8220;trimester&#8221; threshold of state interest in the life of the fetus corresponding to its increasing &#8220;viability&#8221; (likelihood of survival outside the uterus) over the course of a pregnancy. \u00a0States were prohibited from banning abortion early in pregnancy but allowed to impose increasing restrictions or outright bans later in pregnancy.<\/p>\n<p>In the 1992 case\u00a0of\u00a0<a href=\"http:\/\/www.law.cornell.edu\/supct\/html\/91-744.ZS.html\" target=\"_blank\" rel=\"noopener\">Planned Parenthood v. Casey<\/a>,\u00a0which upheld the &#8220;central holding&#8221; in\u00a0Roe, but replaced the trimester system with the point of fetal viability (whenever it may occur) as when a state&#8217;s right to override the woman&#8217;s autonomy begins.\u00a0Casey\u00a0also lowered the legal standard to which states would be held in justifying restrictions imposed on a woman&#8217;s rights.<\/p>\n<p>In an ironic twist,<a href=\"http:\/\/en.wikipedia.org\/wiki\/Norma_McCorvey\" target=\"_blank\" rel=\"noopener\"> McCorvey\/Roe<\/a>\u00a0in 1994 converted to Christianity and expressed remorse for her part in the Roe v. Wade decision. \u00a0She later worked for the pro-life movement for Operation Rescue (now Operation Save America), which\u00a0conducts protests at abortion clinics while promoting a pro-life cause.<\/p>\n<p>The\u00a0<i>Roe<\/i>\u00a0decision is significant when you consider that by\u00a0age 45, about half of American women will have an unintended pregnancy, and about four in ten will terminate their pregnancy. \u00a0Twenty-two percent of all pregnancies (excluding miscarriages) end in abortion.<\/p>\n<p>But since the\u00a0<i>Roe<\/i>\u00a0decision, there as been a decades-long<i>\u00a0&#8220;Roe<\/i>\u00a0Rage&#8221; or &#8220;<i>Roe<\/i>\u00a0Backlash&#8221; against the decision. \u00a0In the last two years alone, 30 states have passed 135\u00a0laws\u00a0restricting access to abortion. \u00a0For example, twenty-one states have adopted laws restricting insurance companies from paying for abortions.<\/p>\n<p>The federal\u00a0<a href=\"http:\/\/www.healthcare.gov\/law\/full\/index.html\" target=\"_blank\" rel=\"noopener\">Affordable Care Act<\/a>\u00a0maintains the\u00a0<i>status quo<\/i>\u00a0of no federal funding for abortions (<a href=\"http:\/\/dpc.senate.gov\/healthreformbill\/healthbill18.pdf\" target=\"_blank\" rel=\"noopener\">http:\/\/dpc.senate.gov\/healthreformbill\/healthbill18.pdf<\/a>), except in cases of rape, incest or when the life of the woman is endangered. A federal judge recently wrote, &#8220;the express language does not provide for taxpayer funded abortion. That is a fact and it is clear on its face.&#8221; \u00a0Insurers selling their plans on the state exchanges taking effect next year must segregate the premiums they collect for abortion coverage, a definite built-in disincentive. \u00a0In addition, under the Act, states can enact stricter rules of their own. \u00a0So far, nineteen\u00a0<a href=\"https:\/\/web.archive.org\/web\/20151118034312\/http:\/\/www.nwlc.org\/resource\/state-bans-insurance-coverage-abortion-endanger-women%E2%80%99s-health-and-take-health-benefits-awa\" target=\"_blank\" rel=\"noopener\">states<\/a>\u00a0bar or restrict insurance companies on their exchanges from covering abortion.<\/p>\n<p><a href=\"https:\/\/web.archive.org\/web\/20150702032113\/http:\/\/abcnews.go.com\/blogs\/headlines\/2013\/03\/north-dakota-voters-to-decide-whether-life-begins-at-conception\/\" target=\"_blank\" rel=\"noopener\">North Dakota<\/a>\u00a0is taking<i>\u00a0Roe<\/i>\u00a0rage to the extreme by\u00a0taking a step toward outlawing abortions altogether by passing what has been termed a &#8220;personhood resolution,&#8221; that\u00a0states a fertilized egg has the same right to life as a person. \u00a0If passed by the voters, the wording would be added to the state&#8217;s constitution. \u00a0In light of\u00a0<i>Roe<\/i>\u00a0and subsequent decisions, the resolution probably violates the U.S. Constitution. \u00a0But if the matter comes before the present U.S. Supreme Court, who knows how it will rule.<\/p>\n<p>On the other side of the coin, the State of Washington is considering legislation that would mandate insurance companies to pay for abortions. \u00a0The proposed\u00a0Reproductive Parity Act\u00a0would require insurers in who cover maternity care &#8212; which all insurers must do &#8212; to also pay for abortions. \u00a0 The bill passed the state House, but must now pass the state Senate and, if it does, will then go before voters.<\/p>\n<p>And in California,\u00a0<a href=\"http:\/\/leginfo.ca.gov\/pub\/13-14\/bill\/asm\/ab_0151-0200\/ab_154_bill_20130122_introduced.pdf\" target=\"_blank\" rel=\"noopener\">AB 154<\/a>\u00a0was introduced, which would expand the number of trained health professionals who can provide early abortion cases. \u00a0 AB 154 would authorize trained nurse practitioners, certified nurse midwives, and physician assistants to provide early abortions. \u00a0Presently, women in 52 percent of California counties do not have an accessible abortion provider. \u00a0If passed, women in rural areas will not have to travel great distances to find a provider.<\/p>\n<p>Some critics of the\u00a0<i>Roe v. Wade<\/i>\u00a0decision argue that the states should have worked out delicate matters like abortion for themselves.<\/p>\n<p>The broad ruling in\u00a0<i>Roe<\/i>\u00a0stopped activity in state legislatures, created polarization and some would say, damaged the authority of the court. \u00a0But in &#8220;Backlash to the Future? From\u00a0<i>Roe<\/i>\u00a0to\u00a0<i>Perry<\/i>,&#8221;\u00a0the authors dispute this so-called\u00a0<i>Roe<\/i>\u00a0Rage or\u00a0<i>Roe<\/i>\u00a0Backlash. \u00a0\u201cBefore\u00a0<i>Roe<\/i>,\u201d they wrote, \u201cdespite broad popular support, liberalization of abortion law had all but come to a halt in the face of concerted opposition by a Catholic-led minority. It was, in other words, decidedly not the case that abortion reform was on an inevitable march forward if only the Supreme Court had stayed its hand.\u201d \u00a0Thus, it may have been time for the Supreme Courts to step in to vindicate the rights of the minority even at the risk of a rage or backlash.<\/p>\n<p>Forty years later, the\u00a0<i>Roe v. Wade<\/i>\u00a0decision still ignites rage and a backlash. \u00a0The opponents of legalized abortion appear to be gaining ground and as a result, the cause of women&#8217;s reproductive rights are set back. \u00a0Do we really want to go back to those dark days of back alley abortions with a coat hanger or knitting needle, causing injury and sometimes even death?<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On January 22, 1973, the U.S. Supreme Court in Roe v.
