Stone<\/a><\/strong><\/p>\n<p>June 15, 2013<\/p>\n<p>Bradley Manning, a U.S. Army soldier, admitted sending 700,000 government documents to <a href=\"https:\/\/web.archive.org\/web\/20221115184203\/https:\/\/wikileaks.org\/\">Wikileaks<\/a> in 2010.\u00a0 It was the biggest leak of classified information in U.S. history.<\/p>\n<p>Manning is now charged under\u00a0<a href=\"https:\/\/web.archive.org\/web\/20160410042043\/http:\/\/usmilitary.about.com\/od\/punitivearticles\/a\/mcm92.htm\" target=\"_blank\" rel=\"noopener\">Articles 92<\/a>\u00a0and\u00a0<a href=\"https:\/\/web.archive.org\/web\/20140720131834\/http:\/\/usmilitary.about.com\/od\/punitivearticles\/a\/134.htm\" target=\"_blank\" rel=\"noopener\">134<\/a>\u00a0of the\u00a0<a href=\"http:\/\/www.loc.gov\/rr\/frd\/Military_Law\/pdf\/MCM-2012.pdf\" target=\"_blank\" rel=\"noopener\">Uniform Code of Military Justice<\/a>\u00a0(UCMJ), which incorporates parts of the Espionage Act in\u00a0<a href=\"https:\/\/web.archive.org\/web\/20150922020606\/http:\/\/usmilitary.about.com\/library\/milinfo\/mcm\/bl106a.htm\" target=\"_blank\" rel=\"noopener\">Article 106a<\/a>\u00a0of the UCMJ. \u00a0The Manning case is ongoing at Fort Meade, Maryland.<\/p>\n<p>On April 10, 2013 Colonel Denise Lind, the military judge handling Manning&#8217;s case, imposed a demanding burden on the prosecution, ruling that prosecutors must prove beyond a reasonable doubt that Manning had reason to believe his actions would harm the U.S. or aid a foreign power.<\/p>\n<p>Basically the government is saying that leaking classified information to a publication is the same as leaking to the enemy.\u00a0 Ironically, a publisher has a First Amendment right to publish leaked information, whereas Manning has no right to leak the information.<\/p>\n<p>The prosecution rejected Manning\u2019s offer to plead guilty to\u00a0several charges including misusing classified material, which would have meant up to 20 years in jail. \u00a0The government, instead, is playing hardball,\u00a0treating Manning like a traitor rather than a leaker. \u00a0This is the first time that someone is being charged with aiding the enemy simply for leaking information to the press.\u00a0 If he is found guilty of \u201caiding the enemy,\u201d Manning could receive a sentence of life in prison or even the death penalty.<\/p>\n<p>Clearly, there is a need for some government\u00a0secrecy. \u00a0For example,\u00a0military plans, intelligence sources, undercover agents, and the capabilities of weapon systems.<\/p>\n<p>Trouble is, when an individual decides to release classified documents, it is often done indiscriminately. That is, information that is classified because its release will embarrass the government as well as information that probably should be kept classified.<\/p>\n<p>According to Manning\u00a0testimony,\u00a0&#8220;Given all of the Department of State\u00a0information\u00a0that I read, the fact that most of the cables were unclassified, and that all the cables have a SIPDIS caption [messages intended for automatic Web publishing, according to the U.S. Department of State Foreign Affairs Manual],\u00a0I believed that the public release of these cables would not damage the United States;\u00a0however, I did believe that the cables might be embarrassing, since they represented very honest opinions and statements behind the backs of other nations and organizations.&#8221;<\/p>\n<p>It is important to note that Manning testified &#8220;most of the cables were unclassified\u201d indicating that possibly some were not.<\/p>\n<p>Thus, prosecutors will attempt to show that the release of some of the leaked information placed U.S. service personnel in harm&#8217;s way or exposed sensitive intelligence activities. \u00a0For example, the prosecution has already presented evidence that code words and the name of at least one enemy target were revealed, and a leaked video of a <a href=\"https:\/\/web.archive.org\/web\/20150403020701\/https:\/\/collateralmurder.com\/\">U.S. Apache helicopter attack<\/a> that ostensibly revealed sensitive information that could help enemies plan deadlier assaults.\u00a0 I expect the prosecution will present more such evidence.<\/p>\n<p><center><iframe loading=\"lazy\" width=\"480\" height=\"360\" src=\"http:\/\/www.youtube.com\/embed\/5rXPrfnU3G0?rel=0\" frameborder=\"0\" allowfullscreen><\/iframe><br \/>Collateral Murder<\/br><\/center><\/p>\n<p>By his own admission, Manning broke the law by releasing classified information and for that, at the minimum, he probably will face a less than honorable discharge and some jail time. \u00a0 But even if it can show some of the leaked material may have aided the enemy, the prosecution will have to show\u00a0beyond a reasonable doubt that Manning had reason to believe his actions would harm the U.S. or aid a foreign power.\u00a0 This is a difficult burden for the prosecution.<\/p>\n<p>Manning has been in jail since his arrest on May 29, 2010. \u00a0He spent his first nine months in a Marine brig in Quantico, Virginia where\u00a0he was reportedly held in solitary confinement for 23 hours a day,\u00a0forced to sleep naked without pillows and sheets on his bed, and restricted from physical recreation or access to television or newspapers even during his one daily hour of freedom from his cell. \u00a0This maltreatment was all under the pretense that the Manning was a suicide risk. \u00a0His treatment caused a public outcry as his treatment was reminiscent of the conditions of suspected terrorists held at\u00a0Guant\u00e1namo Bay.<\/p>\n<p>The Manning case, Daniel Ellsberg\u2019s release of the Pentagon Papers, and the recent case of Edward Snowden, the National Security Administration leaker, remind me of Henry David Thoreau&#8217;s &#8220;<a href=\"https:\/\/web.archive.org\/web\/20180105012447\/http:\/\/www.constitution.org\/civ\/civildis.htm\" target=\"_blank\" rel=\"noopener\">On the Duty of Civil Disobedience<\/a>.&#8221; Thoreau argued that\u00a0individuals should not permit governments\u00a0to overrule or atrophy their\u00a0consciences, and that they have a duty\u00a0to avoid allowing such acquiescence\u00a0to enable the government to make them the agents of\u00a0injustice. Thoreau was motivated in part by his disgust with slavery\u00a0and the Mexican-American War.<\/p>\n<p>The government has the right and possibly the duty to prosecute Manning for leaking classified information.\u00a0 However, the government here has overreached by charging Manning with treason for an act that is criminal at most.<\/p>\n<p>If Manning is convicted of treason, will this deter others from engaging in similar acts of civil disobedience?\u00a0 I doubt it. \u00a0There are about 1.5 million Americans with top secret clearances who work for the government or private contractors. \u00a0That&#8217;s a lot of potential leakers if the public&#8217;s understandable distrust of government continues unabated.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Bradley Manning, a U.S. Army soldier, admitted sending 700,000 government documents to Wikileaks in 2010.
